Abstract

Abstract: Badal hajj is the hajj that a muslim to replace the implementation of the hajj others. Badal hajj is identical with wages because of the hajj, which replaced that require a fee in accordance with that specified by the person who replaced (badil).When badil does not stipulate how much it costs, then open up opportunities for those who replace (mubdil) to set the cost of the implementation of the hajj is. Some of this wages is a profit of badal hajj implementation. This study aims to determine how the implementation of the hajj as a profit terms of Islamic law. The authors used the field (field research) method by interviewing informants who have done hajj, namely the Indonesian students studying in Egypt and Saudi Arabia, and muqimin Indonesia living in Saudi Arabia. According to the Hanafi Scholars, it does not allow the payment of wages for the hajj, the call to prayer, teaching of the qur'an and fiqh, as well as worship-the worship of the like, because acts of worship that is reserved for the culprit. Meanwhile, the majority of the fuqaha and among mutha'akhirin (generasibaru) Hanafi madhhab allow the granting of wages on the hajj and worship the other. The results of this study show that the implementation of the hajj performed by the students of Al-Azhar University of Egypt and the Islamic University of Madinah in accordance with the provisions of Islamic law. While the hajj by the muqimin in Mecca there is that in accordance with the laws of hajj there are not, this is because the number of violations committed during the hajj, because its main purpose is only to seek profit/profit/commercial not prioritize of “mabrur” of hajj implementation. In Islamic law, commercialization, which made it permissible for is not in conflict with the terms and pillars of hajj applicable.
